This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.montanyarum.com or use any of the online and digital apps and services we use, including but not limited to social media platforms like Facebook and Instagram and email platforms like ConvertKit (the “Site”).

Our Website and online/digital platforms are operated by Montanya Distillers. Throughout the Site, the terms “we”, “us” and “our” refer to Montanya Distillers. This policy is intended to work in concert with our Terms of Use.

Personal Information We Collect

When you visit the Site, our social media pages or subscribe to our newsletters and email communications, we automatically collect certain information about your device including information about your web browser, IP address, time zone, geographic location and some of the cookies that are installed on your device.

Additionally, as you browse the Site or click links on social media/in emails, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “User Information.”

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, and payment information (including but not limited to credit card numbers, email address, and phone number). We refer to this information as “Order Information.”

From time to time we also collect user information through offline events, including conferences, trade shows and rum education events. We also offer a voluntary loyalty program in the Tasting Room, for which we collect information such as name, accumulative purchases, etc.

When we talk about “Personal Information” in this Privacy Policy, we are talking about device information, order information and user information.

Legal Justification for Collecting Information

We collect and process personal information for individuals who give consent to receive marketing and communications emails from us, who engage with the website and/or social media and other apps, and/or purchase items from the store.

We collect, store and access user information, order information and device information through third party platforms, including the following:

We will occasionally transfer personal information from one platform to another, such as MailChimp to ConvertKit, when transitioning to a new platform or when collection processes require it. Any files or data downloaded for this purpose are deleted after use, and we do not store personal information on our internal server or in our internal file system.

How We Use Your Personal Information

We use the analytics provided by the sites listed above and on occasion conduct our own analyses to understand consumer interest in and engagement with our website, blog and email content, as well as social media posts. Our own analyses consider information such as most clicked links, most viewed pages and top geographic locations of users. This information informs the development of future content, including topic, length, format and promotion.

We use the order information that we collect to fulfill orders placed through the site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). We also use this information to analyze sales from the online store and follow proper accounting procedures.

When in line with the preferences you have shared with us, we use this order information to provide you with information or advertising relating to our products or services, including but not limited to weekly and/or monthly email communications in the form of newsletters.

We use the device information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). We also use device information to inform and target online advertising through social media websites such as Facebook and Instagram.

Sharing Your Personal Information

The third parties listed above collect and analyze your personal information, which we access as described.

We may share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

We will not sell or share our email list with any other providers or third-party entities.

Social Media Promotions and Sharing of Content

We may from time to time request you post comments and images from your social media account(s) (including, but not limited to, Instagram, Twitter and Facebook) with certain hashtags. In certain instances, if you add those hashtags to your image, depending upon your social media privacy settings, the image may be redisplayed on our Services. While you retain ownership of the image, using the hashtags we request gives us permission to display and re-display the image. The image may contain information about you, and we may collect and use that information for marketing and research purposes. If you do not want your image posted on our Services, please do not use our requested hashtags.

From time to time we share social media content from other parties, such as Crested Butte area photographers. We share this content with permission from and credit to the original owner.

Similarly, we may from time to time request that you share content such as social media posts or newsletters. In certain instances, if you share this content, personal and user information will show up in our analytics and we may use and collect that information for marketing and research purposes. If you do not want this type of information collected, please do not share our content in this manner.

On Squarespace, we have disabled Squarespace analytics cookies so that Squarespace does not place non-essential cookies on website visitors’ browses. We have also opted not to enable the Activity Log, which means that we don’t collect or see IP addresses or other personal data for individual visitors to the website.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Data Retention

When you place an order through the Site, we will maintain your order information for our records, not including credit card data, unless and until you ask us to delete this information. All credit card information is handled via third party platforms and we do not have access to credit card numbers.

When you subscribe to our email lists or access our websites or other online communication platforms, we will maintain your device information for our records unless and until you ask us to delete this information.

Any data collected and analyzed through third parties, including but not limited to Squarespace, Instagram and Facebook, is housed through their websites and retained in accordance with their terms of use and privacy policies.

Updating, Requesting and Deleting Personal Data

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. We offer this same service to non-European residents as well.

All email subscribers may update their personal information at any time by clicking the “update your profile” link at the bottom of every email. You may also contact us at info@montanyadistillers.com or via the contact information below.

You may request a copy of your personal data or that we delete your personal data by contacting us at info@montanyadistillers.com or the contact information listed below. We will comply and notify you of that compliance within 30 days.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to the United States.

Minors

The Site and any related online and print communications, including email newsletters, social media posts and online advertising, are not intended for individuals below the legal drinking age in their place of residence or location. Individuals under 21 in the U.S. or below the drinking age in the country where they are located should not view the content, and users who are of age should not share the content with those who are not. We do not knowingly collect the personal information of individuals below the legal drinking age or those who live in countries where the sale or advertising of alcohol is illegal.
